New Talcum Powder Lawsuit Removed To Federal Court

A Johnson & Johnson's baby powder cancer lawsuit in Missouri was removed by the defendants to the Eastern District of Missouri Federal Court on May 20.

Tuesday, June 7, 2016 - A Johnson & Johnson's baby powder ovarian cancer lawsuit in Missouri was removed to federal court on May 20. The lawsuit was removed to federal court following a motion by the defendants claiming that the state court in which the lawsuit was housed lacked personal jurisdiction over the more than 30 states from which the claims hailed. The removal notice requested that all of the non-Missouri residents in the lawsuit be dismissed. There are 80 plaintiffs total in this talcum powder lawsuits, none of whom are related.

The talcum powder cancer lawsuit that was removed to federal court by the defendants is just one of more than 1,000 pending around the country accusing the health care company of intentionally putting their consumers at risk for ovarian cancer, which had been linked to their talcum powder products in a number of medical studies. Two Johnson & Johnson's baby powder lawsuits recently went to trial in Missouri and fetched a total of $127 million in damages between the plaintiffs. It marks a tenuous time for the defendants in the talcum powder litigation, and they are attempting to take every legal advantage possible to tilt the scales in their favor and against the plaintiffs who claim they contracted ovarian cancer from Johnson & Johnson's talcum powder products.

The talcum powder cancer lawyers are not just pursuing these claims based on plaintiff allegations alone. There are decades of medical research into the correlation between talcum powder and an increased risk of ovarian cancer, with published studies reaching back from the early 1970's to the present day. The most recent research has placed the increased risk associated with regular genital use of talcum powder at close to a third compared to women who do not use the product.

There have also been internal Johnson & Johnson documents recovered by talcum powder attorneys that reveal the company had been warned by doctors working as consultants that the research behind talcum indicated that it was a likely carcinogen. These documents have proved significant in the trials that have occurred thus far, as jurors reacted strongly to the fact that Johnson & Johnson knew of these problems and intentionally decided to withhold that information from consumers. Many jurors commented on the evidentiary weight these documents held in deliberations after the trials were complete.

Missouri remains one of the main hubs for Johnson & Johnson's baby powder ovarian cancer lawsuits, with New Jersey, the home of Johnson & Johnson, being the other. There are at least 1,200 talcum powder lawsuits currently filed around the country, and another was recently filed in Canada. There remains much at stake for both sides in the baby powder lawsuit litigation, although it would seem that the plaintiffs and their talcum powder attorneys currently have the upper hand following the two massive awards given to plaintiffs in 2016. The next talcum powder ovarian cancer lawsuit will take place in September this year before the City of St. Louis Circuit Court, where the first two claims that won damages were heard.
