New Baby Powder Lawsuit Filed In Eastern Louisiana

The mother of a woman who died from ovarian cancer has filed a Johnson & Johnson's baby powder cancer lawsuit on behalf of her daughter.

Monday, October 17, 2016 - The latest of more than 1,200 talcum powder ovarian cancer lawsuits has been filed in Louisiana, this time by a mother on behalf of her daughter who passed away from ovarian cancer in November of 2015. The lawsuit, which was filed on October 12, claims that Johnson & Johnson's failure to warn the plaintiff of the links between their talcum powder products and ovarian cancer led directly to her diagnosis and eventual death at the hands of the disease. The claim was filed in the U.S. District Court for the Eastern District of Louisiana and named Imerys Talc America Inc. and the Personal Care Products Council as defendants in addition to the lead defendant Johnson & Johnson.

The talcum powder lawsuit was filed by Lucy Tetlow, who brought the claim on behalf of her daughter Laurie Tetlow. The lawsuit alleges that Johnson & Johnson acted negligently and perhaps willfully to conceal medically published findings that a significant link existed between the regular, genital use of talcum powder by women and an increased risk for the development of ovarian cancer. The health care company has maintained that they do not believe talcum powder is linked to ovarian cancer, despite a significant amount of evidence suggesting otherwise.

The talcum powder attorneys representing Tetlow referenced more than 20 medical studies demonstrating this link in the baby powder cancer lawsuit, in addition to citing internal documents recovered from Johnson 7 Johnson in the 1990s that proved the company was aware of the ovarian cancer risk for decades and never chose to apply a warning label to its products.

Recently, the Judicial Panel on Multidistrict Litigation consolidated a number of federal claims into multidistrict litigation to help baby powder lawyers better deal with the sheer volume of claims that are expected in the coming weeks and months.

For now the talcum powder attorneys representing Tetlow will proceed with the claim before the U.S.District Court for the Eastern district of Louisiana and likely keep an eye on the trial currently taking place in St. Louis for any potential developments, whether or not the plaintiff receives a favorable decision.
